The documents BLS cannot legally require from you

Know the legal limits of BLS Spain staff: papers they cannot ask for, what the BOE says and how to act if your file is rejected at the counter.

You arrive at your appointment at BLS with all the documents required by the official website of the Spanish Consulate. However, the counter employee tells you with disdain: 'You are missing the paid flight reservation', 'Your bank statement is useless without a notarized letter' or 'We need your rental contract before granting the visa'.Does BLS have the power to invent requirements that are not in the law?Know your legal rights and how to act.

The BLS Strictly Receiving Function

It is essential to understand the legal nature of BLS International: it is a third-party logistics provider contracted to receive folders, digitize papers, and take biometrics. Its employees are NOT consular officials, they are NOT immigration judges and they are NOT legally assigned any power to classify or prosecute files.

Article 8 of the Community Visa Code and the MAEC specifications establish that the evaluation of the substance of the file corresponds exclusively to the diplomatic staff of the Consulate General of Spain.

Illegal Demands that Counter Staff Usually Invent

  1. Paid Airline TicketsEuropean regulations prohibit requiring the formal purchase of non-refundable airline tickets before the visa is granted.Only a reservation or estimated flight itinerary is required.
  2. Long-Term Rental Contracts in SpainFor student or nomadic visas, it is not required to have a signed one-year rental contract before having the visa granted; It is enough to prove an initial accommodation reservation (residence, hotel or temporary reservation letter).
  3. Translations of Documents That Are Already in SpanishCases have been documented where counter employees demand to 'translate' documents from Colombia, Mexico or Peru that are already written entirely in the Spanish language.
  4. Obligation to Take the Photo in their Internal BoothIf you provide photographs that comply with the ICAO biometric standard (35x45 mm, white background), they cannot force you to pay for their internal photographic service.

How to Demand They Receive Your File 'Under Your Responsibility'

If a BLS employee refuses to receive your file on the grounds that it is 'missing things that are not on the Consulate's official list,' use the key legal formula:

'I demand that my file be received and sent to the Consulate General of Spain in the state in which it is located, stating that the legal decision corresponds to the Consul and not to this administrative window.'

Key Practical Tips

What the team recommends before you file anything:

  • Always have the official requirements sheet printed on the website of the Consulate General of Spain corresponding to your consular district.
  • If the official insists on refusing reception, immediately request the presence of the Center Supervisor (VAC Manager) and the delivery of the Official Complaints Book of the Spanish Administration.

Required Documentation Checklist

  1. Official checklist from the Spanish Consulate printed along with your file.
  2. All documents ordered exactly in the sequence required by the MAEC.
  3. Knowledge of the difference between 'BOE Legal Requirement' and 'BLS Optional Service'.
  4. Professional firmness at the counter to demand the complete submission of the file to the Consul.
  5. Note of the name of the official and window number in case of incident.
