Spanish citizenship for Peruvians: The 2-year fast-track residency rule
How the Ibero-American Civil Code clause works, which residence permits qualify, and why you keep your original Peruvian passport.

While most foreign nationals must reside legally in Spain for ten uninterrupted years before seeking citizenship, Peruvian citizens benefit from an exceptional historic clause in the Spanish Civil Code: they can apply after just two years of continuous legal residence.
This framework offers one of the fastest pathways to a European Union passport in the world. However, widespread confusion surrounds which visa categories count toward this two-year clock and how to ensure your time starts accruing immediately.
The legal distinction: Study stay vs. Legal residency
The Spanish Civil Code mandates two years of official 'residence'. A student visa confers 'stay' status (estancia), not residency. Therefore, years spent strictly as a student do not count toward citizenship, although they make subsequent transitions to work or nomad residency straightforward.
Visa pathways that trigger the two-year clock
Any full residence authorization starts the two-year timeline: the Digital Nomad Visa (Startup Law), the Highly Qualified Professional (PAC) permit, employer-sponsored work permits, and Non-Lucrative Residency.
Throughout those two years, you must not stay outside Spain for more than three consecutive months to preserve the legal continuity demanded by the Ministry of Justice.
The dual citizenship bilateral treaty
Thanks to the bilateral treaty between Spain and Peru, Peruvian citizens acquiring Spanish citizenship by residency are never required to renounce their Peruvian nationality. You retain both passports with full rights in both nations.
