Question 1

Can I rent an apartment in Spain before arriving without getting scammed?

Accepted Answer

Yes, but it requires extreme caution because 90% of rental scams target people searching from abroad on public portals. Never wire money via Western Union, payment links, or overseas accounts before verifying the landlord's title at the official Land Registry (Nota Simple). Most Spanish agencies also require a local permanent employment contract. Landesp performs in-person visits with live video inspections, audits the contract under Spain's Urban Tenancy Act (LAU), and confirms the property is legally eligible for address registration (empadronamiento).

Question 2

How much upfront deposit is required to move into a rental apartment?

Accepted Answer

Under Spain's Urban Tenancy Act (LAU), the legal security deposit is strictly 1 month's rent for primary residence (2 months for temporary leases). However, for international tenants without local tax records, landlords often request an additional 1 to 2 months as a financial guarantee. Under Housing Law 12/2023, agency brokerage fees for standard residential leases must be paid by the landlord, not the tenant. Plan for an upfront disbursement of 2 to 3 months' rent combining the legal deposit, guarantee, and the first month.

Question 3

What is empadronamiento and how do I register if renting a shared room?

Accepted Answer

Empadronamiento is your official municipal registry entry certifying your place of residence in Spain. It is mandatory to obtain your physical TIE card, register for public healthcare, open resident bank accounts, and enroll children in school. If you rent a room in a shared apartment, the leaseholder or landlord must sign an official municipal authorization form, providing a copy of their Spanish ID (DNI/NIE) and proof of property ownership (IBI or utility bill). Always confirm this in writing before booking.

Question 4

What is the official deposit escrow (IVIMA, Incasòl) and how does it protect my funds?

Accepted Answer

Landlords in Spain are legally mandated to deposit your security deposit into their Autonomous Community's official housing body (such as IVIMA in Madrid, Incasòl in Catalonia, or AVRA in Andalusia) within 30 days of lease signing. This escrow protects tenants from wrongful retention and ensures your funds are legally held until lease termination, where it must be refunded minus any objectively proven damages.

Question 5

Which clauses are legally void or abusive in a Spanish rental contract?

Accepted Answer

Clauses that violate Spain's Urban Tenancy Act (LAU) are null and void by law, including: prohibiting address registration (empadronamiento), forcing tenants to pay for natural wear and tear or major structural appliance repairs (Art. 21 LAU), demanding more than two months of additional financial guarantees for standard residential leases, or unannounced landlord inspections without prior explicit consent.

Question 6

How do I prove financial solvency to rent if I work remotely or lack a Spanish payslip?

Accepted Answer

If you work remotely for an overseas company or are self-employed, you should provide certified tax returns, 3 to 6 months of official bank statements showing healthy balances, and employment or service contracts with sworn translations where appropriate. Having a verified tenant dossier prepared by a relocation service like Landesp significantly increases approval rates with skeptical landlords.

Question 7

What is the exact difference between the NIE and the TIE?

Accepted Answer

The NIE (Foreigner Identity Number) is a permanent alphanumeric tax identifier (e.g., Y1234567-X) assigned by the Spanish government; it never expires and does not prove legal residency on its own. The TIE (Foreigner Identity Card) is the physical biometric card with your photograph and chip certifying that you hold an active, legally granted residency or long-term study stay in Spain. Anyone with a visa valid for more than 6 months must register their fingerprints and obtain their physical TIE within 30 days of arrival.

Question 8

Why is it so difficult to book a police appointment for NIE/TIE fingerprints, and how can it be solved?

Accepted Answer

The police and immigration electronic booking portal experiences heavy bottlenecks due to overwhelming demand, particularly in provinces like Madrid, Barcelona, Valencia, and Malaga. New slots are released on specific days and times. Landesp continuously monitors the official reservation queues and prepares your entire dossier (Tax 790-012, EX-17 form, and empadronamiento) to secure an appointment as soon as official spots open.

Question 9

What is Tax 790 Code 012 and how is it paid before the fingerprint appointment?

Accepted Answer

Tax 790 Code 012 is the official Ministry of the Interior administrative fee for issuing the physical TIE card (priced at €16.08 in 2026). It must be filled out online via the National Police portal, generated as a single PDF with a unique barcode, and paid in cash or card at any participating Spanish bank ATM or counter prior to your appointment. The stamped bank receipt is strictly required at your fingerprint appointment.

Question 10

How long does it take to receive the physical TIE card and what is a lot number (lote)?

Accepted Answer

The physical card takes between 30 and 45 calendar days to manufacture following your fingerprint appointment. Each police station posts a public 'lot number' (lote) showing which batch has arrived for pickup. In busy provinces like Madrid or Barcelona, you must book a separate pickup appointment ('Recogida de TIE') presenting your stamped white receipt and original passport.

Question 11

Can I travel outside Spain while my TIE is in process or renewal?

Accepted Answer

If your initial visa has expired or your prior card lapsed while your renewal or new card is pending, you MUST obtain an 'Autorización de Regreso' (Return Authorization) before leaving Spain. Issued by the National Police, this document permits re-entry into Spanish territory within 90 days. You must show proof of confirmed travel tickets and your stamped pending application slip.

Question 12

Why is applying for the Digital Nomad Visa in Spain (UGE) better than through a consulate?

Accepted Answer

Applying directly through Spain's Large Business Unit (UGE) while legally present on a Schengen tourist entry grants an immediate 3-year residency authorization backed by a statutory 20-business-day positive administrative silence rule. Conversely, consular applications abroad yield only a 1-year visa, take between 2 to 5 months, and lack the legal protection of positive silence.

Question 13

Can I legally work in Spain on a student visa or study permit?

Accepted Answer

Yes. Following immigration regulatory reforms, students enrolled in accredited higher education programs (university degrees, official master's programs, PhDs, and higher vocational training) are automatically authorized to work up to 30 hours per week. The employer registers you with Social Security on a part-time contract. Working hours must not overlap with academic schedules, and wages cannot replace your mandatory proof of economic solvency.

Question 14

How much money must I show to obtain a Spanish student visa?

Accepted Answer

You must demonstrate access to 100% of Spain's IPREM (Public Multiple-Effects Income Indicator) per month, which sits at approximately €600/month in 2026. For a 9-month academic year, you need at least €5,400; for a full 12-month year, roughly €7,200. Proof requires 3 to 6 months of stamped bank statements showing clear, unborrowed funds, or a notarized parental sponsorship commitment.

Question 15

What is the difference between an Official Master's and a School-Specific Master's (Título Propio) if I want to stay?

Accepted Answer

This is a pivotal legal distinction: only Official Master's degrees (accredited by ANECA and listed in the RUCT registry at MECES Level 3) entitle international graduates to the 12-month Job Search Residency Permit and allow progression to PhDs. Non-official diplomas (Títulos Propios) are private institutional awards that do not provide these fast-track work conversion rights.

Question 16

What mandatory criteria must student health insurance meet for visa approval?

Accepted Answer

Immigration authorities and Spanish consulates enforce three non-negotiable insurance rules: 1) Zero copayments (no out-of-pocket costs per visit or emergency); 2) Zero waiting periods (carencias) for hospital admission and diagnostic tests; 3) Full comprehensive coverage matching the Spanish National Health System, including medical repatriation. Regular travel insurances are universally rejected.

Question 17

How much does university tuition cost in Spain for non-EU international students?

Accepted Answer

In public universities, pricing per ECTS credit depends on the Autonomous Region. In regions like Andalusia, Galicia, or Asturias, non-EU students pay identical subsidized domestic rates (€800 to €1,400 per year). Conversely, Madrid and Catalonia impose international surcharges raising annual tuition to €4,000–€8,500. Private universities charge between €8,000 and €22,000 annually across the country.

Question 18

Can I study a full degree or master's program taught 100% in English in Spain?

Accepted Answer

Yes. Major public universities (such as Carlos III University of Madrid, Pompeu Fabra, and Autonomous University of Barcelona) and private institutions (IE University, ESADE) offer over 800 undergraduate and master's degrees taught entirely in English. Admission requires certified B2 or C1 English proficiency (TOEFL or IELTS), while student visa rules remain identical.

Question 19

How much money do I need per month to live comfortably in Spain?

Accepted Answer

In Tier-1 capitals like Madrid or Barcelona, a realistic monthly single budget ranges from €1,200 to €1,600 (shared room: €450–€700; groceries: €250–€350; transport and utilities: €100–€180; leisure: €150–€250). In cities like Valencia, Seville, Granada, or Salamanca, the monthly requirement drops to €850–€1,100 while maintaining a high lifestyle standard.

Question 20

Can I open a Spanish bank account before receiving my physical TIE card?

Accepted Answer

Yes. You can open a non-resident account using your valid passport, entry visa or acceptance letter, and source-of-wealth documentation with traditional banks like Santander, BBVA, or CaixaBank, as well as digital neobanks like Revolut or N26 issuing Spanish IBANs. Once your physical TIE is issued, submit it to switch your account to resident status.

Question 21

Why do Spanish banks freeze international transfers from newly arrived expats?

Accepted Answer

Due to Spain's strict Anti-Money Laundering Law 10/2010 (SEPBLAC). Automated compliance algorithms freeze accounts when sizable overseas transfers land without prior proof of origin. To avoid disruptions, always provide your branch manager with official tax filings, property sale deeds, or grant awards before executing cross-border wire transfers.

Question 22

How much physical cash can I bring into Spain on a flight without declaring?

Accepted Answer

You may carry up to €9,999 (or its equivalent in foreign currency) per passenger without declaration. Bringing €10,000 or more legally requires filing the official Form S-1 declaration at airport customs before passing baggage exit checks. Failure to declare results in immediate administrative seizure and heavy monetary penalties.

Question 23

What is the Beckham Law and how does it benefit expats and digital nomads?

Accepted Answer

The Beckham Law is a special impatriate tax regime (Article 93 of the Spanish Personal Income Tax Act). It caps income tax at a flat 24% on Spanish-sourced labor earnings up to €600,000 per year, bypassing the standard progressive tax brackets that reach 47%+. Furthermore, non-Spanish worldwide income and offshore assets remain exempt from Spanish wealth tax. Application (Form 149) must be filed within 6 months of Social Security registration.

Question 24

Are foreigners entitled to free public healthcare upon arriving in Spain?

Accepted Answer

Immediate public health coverage is granted to foreign nationals actively registered and paying Social Security contributions (under an employment contract or registered self-employment), along with their registered dependents. Those residing under student permits, non-contributing nomad visas, or non-lucrative residencies must maintain private zero-copay health coverage as a statutory visa condition.

Question 25

What is the FNMT Digital Certificate and why do you need it from day one?

Accepted Answer

The FNMT Digital Certificate is your official digital signature in Spain. It is the most powerful bureaucratic tool you can possess: it allows you to complete official administrative procedures 24/7 without booking in-person appointments—including downloading municipal padrón certificates, monitoring immigration files, paying taxes, signing contracts, and accessing Social Security portals.

Question 26

Can I drive in Spain with my home country's driver's license?

Accepted Answer

You may drive using your home license accompanied by an International Driving Permit during your first 6 months of legal residency. After 6 months, you must exchange it at the DGT (Traffic Authority) if your home country has a bilateral reciprocity agreement with Spain (e.g., Colombia, Argentina, Chile, Peru, UK). If your country lacks an agreement (such as the US or Mexico), you must take the standard Spanish driving tests.

Question 27

What are the health requirements to bring a dog or cat to Spain?

Accepted Answer

Pets must have an ISO 11784/11785 compliant microchip, valid rabies vaccination administered post-chipping, an official veterinary health certificate issued within 10 days of travel, and a rabies titer blood test if entering from a non-listed country classified as high-risk by the European Union.

Question 28

How do I register for an autonomous regional health card and assigned family doctor?

Accepted Answer

Once registered on the municipal padrón and affiliated with Social Security, visit your designated neighborhood health center (centro de salud/ambulatorio) with your passport, TIE, and padrón certificate. You will be assigned a primary care physician (médico de cabecera) and issued your regional health card.

Question 29

Is it true that Latin American citizens can obtain Spanish citizenship after 2 years?

Accepted Answer

Yes. Under Article 22.1 of Spain's Civil Code, citizens of Ibero-American nations (including Mexico, Colombia, Argentina, Chile, Peru, etc.), along with Portugal, the Philippines, and Andorra, can apply for Spanish citizenship after just 2 years of continuous legal residence. Note that time spent under a student permit counts as temporary stay rather than legal residence for citizenship calculation until modified to a residency permit.

Question 30

Is it true that rural towns in Spain pay you to move there?

Accepted Answer

No in the exaggerated way viral social media claims: no municipality simply hands out cash grants to move. What does exist are repopulation initiatives like 'Proyecto Arraigo' offering subsidized rentals (€150–€300/month), free childcare, or startup facilities. Furthermore, participating legally requires already holding an authorized Spanish residency and work permit; it cannot be used to regularize status from a tourist stay.

Question 31

What are the key requirements to move to Spain from Mexico in 2026?

Accepted Answer

Applications are handled through BLS centers in Mexico City, Guadalajara, or Monterrey. Requirements include: passport valid for at least 1 year, apostilled Federal Criminal Record Certificate (CNAP), official medical fitness certificate, certified proof of funds, and a zero-copay private health insurance policy authorized in Spain.

Question 32

How do I process a Spanish visa from Colombia at the BLS Bogota center?

Accepted Answer

Appointments are booked through BLS Bogota (Calle 94). Essential documents include: online apostilled criminal records and academic transcripts from the Colombian Ministry of Foreign Affairs, 6 months of stamped bank statements in Colombian Pesos, zero-copay Spanish health coverage, and official university admission or remote work contracts. Processing takes 3 to 5 weeks.

Question 33

What is the difference for Argentine nationals traveling with an EU passport versus a visa?

Accepted Answer

Argentines holding Italian or other EU passports enter under European free movement rights, requiring only municipal registration and the CUE certificate (Certificado de Registro de la Unión / green NIE) backed by a job contract or sufficient funds. Those traveling solely on Argentine passports must secure an entry visa (student, digital nomad, or non-lucrative) through Spanish consulates.

Question 34

What are the legal risks of entering Spain as a tourist and deciding to overstay?

Accepted Answer

Schengen tourist admission strictly limits visits to 90 days within any 180-day window. Overstaying past day 90 places you in irregular immigration status: you cannot work legally, sign residential leases under your name, or fly internationally without facing expulsion orders and up to a 5-year Schengen re-entry ban. The only exceptions that can be legally submitted from within Spain as a tourist (before day 60) are higher education study stays and the Digital Nomad residency (UGE).

Question 35

What exactly does Landesp do and how does it differ from a traditional agency?

Accepted Answer

Landesp is your local relocation and concierge team in Spain. Unlike traditional filing agencies that only process remote forms, we support you in the real world: conducting in-person housing inspections so you don't get scammed, auditing lease contracts under tenancy laws, coordinating official empadronamiento and zero-copay health insurances, and guiding your police appointments with partner lawyers when legal counsel is needed.

Question 36

How does Landesp help me find housing and avoid scams before my flight?

Accepted Answer

We curate property listings matching your budget and contact landlords directly. Our relocation personal shopper visits the property in person, inspecting water pressure, noise levels, sunlight, heating systems, and neighborhood safety. We issue a comprehensive photographic inspection report with objective pros and cons, confirm ownership with the Land Registry, and audit the lease before any deposit is paid.

Question 37

What happens during the free strategy call with a Landesp coordinator?

Accepted Answer

It is a 20-minute strategic consultation where we review your planned arrival date, target city, relocation purpose (studies, remote work, employment, or family), and budget. We outline your chronological roadmap, detail what we can coordinate on your behalf, and provide a clear, transparent scope of services with fixed upfront pricing.

Question 38

How far in advance should I start preparing my move to Spain with Landesp?

Accepted Answer

The ideal timeline is 2 to 4 months before your intended departure date. This window provides ample time to obtain apostilled criminal records and consular legalizations, finalize university admissions or remote work contracts, and tour rental options so you arrive with your accommodation and paperwork fully coordinated.
